These Terms of Service ("Terms") are an agreement between you and ALEXXIY SOFTWARE LTD, a private limited company registered in England and Wales under company number 17540601, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us", "our").
They govern your use of the TrekPay wallet software for Android, iOS, Linux, Windows, and macOS (the "App"), the website at https://trekpay.space (the "Website"), and the TrekPay bridge servers we operate for the App (together, the "Service").
By downloading, installing, or using the App, or by tapping "I agree" in the App, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. Please read Sections 4 to 6 and 13 to 16 carefully: they explain your responsibilities and the limits of our liability.
Non-Custodial Software Notice
TrekPay, developed by ALEXXIY SOFTWARE LTD, is strictly non-custodial software. All cryptographic private keys and recovery phrases are generated, encrypted, and stored locally on the user's device. ALEXXIY SOFTWARE LTD never collects, accesses, holds, takes custody of, or controls user private keys, recovery phrases, or digital assets, cannot initiate or reverse blockchain transactions, and does not accept, process, or transmit fiat currency.
1. What TrekPay Is, and What It Is Not
1.1. TrekPay is a non-custodial software interface for the Kerrigan blockchain network. It lets you create or import a local wallet, manage your keys on your own device, sign transactions locally, and send and receive KRGN over the Kerrigan network. It also gives you access to protocol features of the Kerrigan network, such as shielded transactions, InstantSend, masternode and BroodNode management, and governance voting.
1.2. We are a software developer. We are not a bank, custodian, exchange, broker, payment institution, electronic money institution, or investment adviser. We do not hold, transfer, exchange, or manage digital assets for anyone; we do not buy, sell, or swap digital assets; we do not accept, process, or transmit fiat currency; and we do not offer accounts, deposits, interest, or yield of any kind.
1.3. Because we never take custody of your assets or control your keys, we are not a cryptoasset exchange provider or custodian wallet provider. We are not registered with, authorised by, or regulated by the UK Financial Conduct Authority or any other financial regulator.
2. Who May Use the Service
2.1. You must be at least 18 years old, or the age of majority where you live if that is higher, and able to enter into a binding contract.
2.2. You confirm that you are not located in, ordinarily resident in, or organised under the laws of a country or territory subject to comprehensive sanctions by the United Kingdom, the European Union, the United Nations, or the United States, and that you are not named on any sanctions or restricted-party list maintained by those authorities.
2.3. You are responsible for making sure your use of the Service is lawful where you live, including any laws on cryptoassets, privacy technology, and tax.
3. Licence, Open Source, and Intellectual Property
3.1. The App's source code is open source under the GNU General Public License v3.0 ("GPL"), as set out in its source repository. Nothing in these Terms limits the rights the GPL gives you over that source code.
3.2. Subject to these Terms and the GPL, we grant you a personal, worldwide, royalty-free, non-exclusive licence to install and use the App builds we distribute. Builds downloaded from an app store are also subject to that store's usage rules (see Section 18).
3.3. The name "TrekPay", the Delta mascot as used in the App, character designs, artwork, and other TrekPay branding (the "TrekPay Marks") are owned by or licensed to ALEXXIY SOFTWARE LTD and are not covered by the GPL. You may not use the TrekPay Marks in a way that suggests you are us, that we endorse you, or that a modified version of the App is our official App, without our written permission. "Kerrigan" and the Kerrigan logo belong to their respective owners.
4. Your Wallet, Keys, and Recovery Phrase
4.1. Your private keys and recovery phrase are created and stored only on your device. You alone are responsible for keeping them, your device, your PIN, and any backups safe.
4.2. We never see your private keys or recovery phrase and cannot recover, reset, or replace them. If you lose them, or someone else gets them, you may permanently lose access to your digital assets. Write your recovery phrase down and keep it somewhere safe offline. Never share it with anyone, including anyone claiming to be us.
4.3. Your digital assets are recorded on the Kerrigan blockchain, not in the App. If the App or our servers become unavailable, you can still access your assets with your recovery phrase in any compatible wallet.
5. Transactions and Network Fees
5.1. You alone create, sign, and broadcast transactions, using keys on your device. We cannot start, approve, block, cancel, or reverse any transaction.
5.2. Transactions on the Kerrigan blockchain are final and irreversible. Check every address and amount before sending. We cannot recover digital assets sent to a wrong address or lost through a mistake, a compromised device, or fraud by someone else.
5.3. The Kerrigan network charges transaction fees, which are paid to the network, not to us. The App estimates fees, but the actual fee depends on the network. Network fees are not refundable.
5.4. We do not charge any fee to download or use the App.
6. Masternodes, BroodNodes, Governance, and KNS Names
6.1. These are features of the Kerrigan protocol or of independent third-party services. The App only gives you a way to use them from your own wallet.
6.2. Masternodes and BroodNodes. Running one requires collateral and a server that you or a hosting provider of your choice operates. Rewards are set by the Kerrigan protocol, not by us. They are not guaranteed and they are not interest or a return from us. We do not host nodes for you, we do not vet or endorse hosting providers, and we are not responsible for a node's uptime or rewards.
6.3. Governance. Governance votes are signed on your device with your node keys. Submitting a proposal requires a fee set by the Kerrigan network, which the network consumes and which is not paid to us. The outcome of any proposal is decided by the network.
6.4. KNS names. KNS names are provided by Kerrigan NameSpace, a service separate from the App. Its rules and any fees apply to your registrations, and we are not responsible for that service.
7. Voluntary Donations
The App's optional "Fuel Delta" screen lets you send a voluntary donation to support development. Donations are gifts: they are optional, do not unlock any feature, give you no rights, ownership, or return of any kind, and, like all blockchain transactions, cannot be refunded.
The KRGN price and the values shown in Easy Crypto mode come from third-party sources, currently vote.kerrigan.network and CoinGecko, and are for information only. They may be delayed or inaccurate. Nothing in the Service is financial, investment, legal, or tax advice, or a recommendation or invitation to buy, sell, or hold any cryptoasset. Please get independent advice where needed.
9. Third-Party Services and Network Infrastructure
9.1. The App connects to Kerrigan blockchain servers (by default, our TrekPay bridge servers, or any node you choose) and to third-party services described in our Privacy Policy. It may also link to third-party websites, block explorers, and community channels.
9.2. We do not control third-party services and are not responsible for their content, availability, accuracy, or practices. Your use of them is at your own risk and may be governed by their own terms.
9.3. We may change, limit, or stop operating our bridge servers at any time. You can always connect the App to your own kerrigan-bridge server or another compatible node.
10. Prohibited Use
You must not use the Service to:
- break any law or regulation that applies to you, including sanctions, anti-money-laundering, and counter-terrorist-financing laws;
- send or receive the proceeds of crime or fraud, or fund any illegal activity;
- defraud, deceive, or harm us, other users, or anyone else;
- overload, disrupt, attack, or abuse our bridge servers or the Service, including through denial-of-service attacks, spam, or automated scraping;
- introduce malware or any other harmful code;
- use the TrekPay Marks in breach of Section 3.3, or falsely suggest that you are, or are endorsed by, us or the Kerrigan project; or
- help or encourage anyone else to do any of the above.
11. Updates, Suspension, and Termination
11.1. We may update, change, or discontinue the App, the Website, or our bridge servers, in whole or in part. We are not obliged to provide support or updates, although we try to fix important problems.
11.2. If you breach these Terms, we may block your access to our bridge servers. You can stop using the Service at any time by uninstalling the App. Sections 3.3, 4, 5, 12 to 16, and 20 continue to apply after you stop using the Service.
12. Risks You Accept
You understand and accept that:
- the value of cryptoassets can change quickly and may fall to zero;
- cryptoassets attract phishing, scams, malware, and theft. Fraudsters may impersonate us. We will never ask for your recovery phrase;
- software, including open-source cryptographic software, can contain bugs. Delays, sync problems, or incorrect balances can occur if servers are offline or the network is congested;
- the Kerrigan protocol and its features, including shielded transactions, InstantSend, masternodes, and BroodNodes, can change, fork, or fail, and are not controlled by us; and
- laws on cryptoassets and privacy technology can change and may affect your ability to use them.
13. Disclaimers
13.1. The Service is provided free of charge, "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions, and terms not expressly set out in these Terms, including implied terms of satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, secure, or free of harmful components.
13.2. If you are a consumer, nothing in these Terms affects the statutory rights that you cannot give up by contract under the laws of the country where you live.
14. Limitation of Liability
14.1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
14.2. Subject to Section 14.1, we are not liable for any loss of digital assets, loss of profits, revenue or data, or any indirect or consequential loss, arising from or relating to your use of, or inability to use, the Service. This includes losses caused by lost or stolen keys or recovery phrases, a compromised device, transactions you make, mistakes in addresses or amounts, third-party services, network forks, or the behaviour of the Kerrigan network.
14.3. Subject to Section 14.1, our total liability to you for all claims arising from or relating to these Terms or the Service is limited to the greater of the amount you paid us for the App (which is zero) and fifty pounds sterling (£50).
15. Indemnity
To the extent permitted by law, you agree to compensate us for any claims, losses, and reasonable costs (including reasonable legal fees) that arise because you breached these Terms or the law. This section does not apply to you if you are a consumer and the law where you live does not allow it.
16. Governing Law and Disputes
16.1. If you have a complaint, please email support@trekpay.space first, describing the issue and what you would like us to do. We will try in good faith to resolve it within 30 days.
16.2. These Terms, and any dispute or claim arising from them or the Service (including non-contractual disputes), are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, but if you are a consumer you may also bring proceedings in the courts of the place where you live.
16.3. If you are a consumer living outside England and Wales, you keep the protection of any mandatory provisions of the law of your country of residence.
17. Changes to These Terms
We may update these Terms, for example to reflect changes to the Service or the law. We will post the new version on this page with a new "Last updated" date and, for significant changes, give notice on the Website or in the App. If you keep using the Service after the changes take effect, the new Terms apply to you. If you do not agree with them, stop using the Service.
18. App Store Terms
18.1. App Store. If you download the App from the App Store, the following also applies:
- These Terms are between you and ALEXXIY SOFTWARE LTD only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
- Your licence to use the App is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- We, not Apple, are solely responsible for any maintenance and support of the App. Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Any other claims, losses, liabilities, damages, costs, or expenses caused by any failure to conform to a warranty are our responsibility, to the extent set out in these Terms.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- If a third party claims that the App or your possession and use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the App, such as your mobile data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
- Questions, complaints, or claims about the App should be sent to us at the address in Section 21.
18.2. Google Play. If you download the App from Google Play, the Google Play Terms of Service also apply to your download. These Terms are between you and ALEXXIY SOFTWARE LTD only, and Google is not responsible for the App.
19. Privacy
Our Privacy Policy explains what information the Service processes and how. It forms part of these Terms.
20. General
20.1. These Terms, together with the Privacy Policy and the GPL for the source code, are the entire agreement between you and us about the Service.
20.2. If a court finds any part of these Terms invalid or unenforceable, the rest stays in effect.
20.3. If we do not enforce a right straight away, we can still enforce it later.
20.4. We may transfer our rights and obligations under these Terms to another organisation, for example if our business is sold. This will not reduce your rights. You may not transfer your rights under these Terms without our written consent.
20.5. We are not responsible for delays or failures caused by events beyond our reasonable control, such as network attacks, blockchain forks, internet or power outages, natural disasters, or government action.
20.6. Except as stated in Section 18.1 for Apple, nobody other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
20.7. We welcome feedback. If you send us ideas or suggestions, you allow us to use them freely and without payment to improve the Service.
20.8. You agree that we may give you notices electronically, for example by email, on the Website, or in the App. These Terms are available in English only.
